Abstract EN

This study aims to propose some regulations for bridging existing gaps in commercial court system concerning businesses and effective legal actions taken in this regard.

The study is organized into an introduction and two sections.

The first section defines businesses concept and elements.

The second section discusses key legal actions in force regarding businesses.

It was revealed that business regulations were not stipulated in Saudi legal system particularly commercial courts.

Businesses, as concluded in the study, comprised tangible and incorporeal movables and or assets utilized by business owners and shopkeepers in any business activity.

Elements of any business should have a business-oriented function and in the best interest of that business activity.

Small businesses need not necessarily meet all business elements as such elements vary depending on the type of business.

It was concluded that business commercial mortgages disclosure was imperative as concrete evidence at hand.

The important conclusion was that business commercial mortgaging system should be debtor-credit/loan based rather than debtor-driven and or creditor-based and that credits should be economic ones.
