يهدف هذا البحث إلى دراسة ضمان الصناديق الاستثمارية، فيما لو خسرت الصناديق الاستثمارية و أفلست، هل يمكن ضمان حقوق المستثمرين المالية؟ و كيف تقوم الصناديق لاستثمارية بتحفيز لمستثمرين؟ و هل يمكن ضمان أموالهم و يكون ذلك تحفيزا لهم للاستثمار؟ تناولت بيان ذلك في (ضمان لصناديق الاستثمارية) دراسة فقهية، و قد قسم البحث إلى مقدمة و ثمانية مباحث و خاتمة، المقدمة تشمل على (أهمية الموضوع، و أهداف البحث، و منهج البحث، و تقسيماته) و بين المبحث الأول : تعريف الصناديق الاستثمارية و في المبحث الثائي تناولت : أنواع الصناديق الاستثمارية في ستة مطالب : الأول : صناديق العملات و الثاني : صناديق الأسهم و الثالث : صناديق السندات و الرايع : صناديق السلع أو البضائع.
الخامس : صناديق الذهب، و المعادن النفيسة و السادس : صناديق الاستثمار في الصكوك و تناول المبحث صورة الصندوق الاستثماري وبين المبحث الرايع: التكييف الفقي لصناديق الاستثمار وتناولث في لمبحث الخامس: مخاطر الصناديق و بينت في المبحث السادس : ضمان الصناديق الاستثمارية في حالة عدم لتعدي أو التفريط ثم في المبحث السابع : ضمان الصناديق الاستثمارية في حالة التعدي أو التفريط و ختاما المبحث الثامن : تبرع طرف ثالث بضمان الصناديق الاستثمارية و توصل البحث إلى أهمية دراسة ما يتعلق بضمان الصناديق الاستثمارية، و شمول الشريعة الإسلامية لكل جوانب الحياة ؛ إذ جاءت بكل ما يكفل سعادة الإنسان، و عناية الفقهاء بكل ما يتعلق بالجوانب الحقوقية.
Abstract EN
This research aims to study the insurance of investment funds through addressing the following questions : can the fiscal rights of the investors be guaranteed in case of loss or bankruptcy of investment funds? how do investment funds attract investors? the research was divided into an introduction, eight sections and a conclusion.
the introduction included the research significance, objectives, and methodology.
the eight sections dealt respectively with the following topics: definition of investment funds, types of investment funds, image of investment funds, jurisprudential adaptation of investment funds, risks of investment funds, insurance of investment funds in case of non-infringement or negligence, insurance of investment funds in case of infringement or negligence, and donation for the insurance of investment funds.
the research revealed the importance of studying issues related to the issuance of investment funds, and the inclusion of islamic sharia to all aspects of life including the legal aspects.
