As a result of recent technological developments, electronic commerce has increased pressure on the consumer by receiving advertising emails without his consent, in order to lure him into the world of electronic commerce and motivate him to contract via the Internet, and for this the consumer’s interest has been protected from false electronic commercial advertisements.

The Algerian legislator sought to provide criminal protection for this type of illegal or unwanted electronic advertisements through the Electronic Commerce Law 05/18.

In order to study this topic, it is necessary to consider the nature of illegal or false electronic advertising, and then to the pillars of the crime of illegal electronic advertising.
