تهدف الدراسة إلى البحث في آليات ضمان الاستقرار بعد حالات الانتقال.
فتأسيس دولة القانون لا يتحقق بإنهاء النظام الفاسد فقط، بل يتوجب بناء مؤسسات تحول دون العودة لما سبق.
لذا، تقترح، وفقا لمنظور قانوني، عدة نماذج لتصميم دستور ينشئ مؤسسات تضمن الاستقرار و الفعالية و تحول دون تهيئة ظروف لبعث النظام الاستبدادي السابق.
لكن هذه النماذج غير قابلة للتعميم على كل التجارب، فينفرد كل مجتمع بظروفه التي تملي أطر تأسيسية معينة.
Abstract EN
The purpose of this research is to study the mechanisms guaranteeing stability after a democratic transition in order to establish the state of law.
however, the establishment of a universal constitutional model is impossible, some solutions are proposed to create democratic institutions according to the political context of the state.

Cette recherche a pour objet l’étude des mécanismes garantissant la stabilité après une transition démocratique afin d’établir un état de droit.
bien que, juridiquement, l’instauration d’un modèle constitutionnel universel soit impossible, on propose quelques solutions pour créer des institutions démocratiques selon le contexte politique de l’état.
