التجارة الإلكترونية من العقود المستجدة التي تحقق اليسر، و السهولة في التعامل و قد حكم بجوازها، و دل على مشروعيتها الكتاب، و السنة، و الإجماع، و المعقول، لكن بشرط أن تراعي القواعد و الضوابط الشرعية التي يجب مراعاتها في سائر المعاملات الأخرى.
و لأهمية التجارة الإلكترونية و حاجة الناس إليها و ضرورتها كان لابد من طرح تساؤلات يهدف البحث للإجابة عليها : منها : ما هو تعريف التجارة الإلكترونية ؟ و ما هي أدلة مشروعيتها ؟ و ماهي الضوابط الشرعية و القانونية لها ؟ و مدى توافق القانون 18-05، مع ضوابط الشريعة الإسلامية ؟ و من أهم النتائج المتوصل إليها إن الشريعة الإسلامية مع كل وسيلة تحقق اليسر و السهولة في التعامل، بشرط أن تراعي الضوابط الشرعية و التي من بينها-التراضي و تحقيق العدالة، و المنفعة، لأطراف العقد.
إن الشروط التي وضعها المشرع الجزائري لتنظيم التجارة الإلكترونية لا يتعارض مع منهج الشرعة الإسلامية القائم على جلب المصالح و در المفاسد.
Abstract EN
Electronic commerce is one of the new contracts that achieves ease of dealing for that.
it is permissible, and is legitimate in the Qur'an and Sunnah, consensus, and reasonableness, but on the condition that it takes into account the legal rules and regulations that must be observed in all other transactions.
because of the importance of e-commerce and people's need and necessity for it, we asked the following question : what is the definition of e-commerce ? what is the evidence for its legitimacy ? what are his rules in Islam and law ? does it compatible with law 18-05 ? among the most important results reached is that Islamic legislation calls for every means to achieve ease in dealing, provided that the legal controls are taken into account, among which are satisfaction, justice, and benefit between the contracting parties.
also, the conditions set by the Algerian legislator to regulate electronic commerce do not contradict the approach of Islamic legislation based on bringing interests and keeping harm away.
