This is a study of an inheritance or legacy issue called “polytheism” Riwaya and Deraya, by collecting its narrations and methods, studying its chains of transmission, judging it according to what suits it, studying and criticizing their titles, clarifying the sayings of scholars in their division, reviewing the evidence of each team, answering them, and weighing what they testify to.

in my study, i followed the inductive approach, collecting the narrations mentioned in this issue, the sayings of scholars and their evidence, then the critical and analytical approach, in criticizing the effects and terminology contained in the issue, and analyzing the jurisprudential opinions, and standard arguments.

in this study, i found : 1-scientific terms should not be treated as postulates that cannot be criticized, even if the general scholars follow them.

2-the scholars’ saying : “there is no confusion in the terminology,” not in its absolute terms.

this must be restricted so that the terminology does not contradict the book, the Sunnah, or the legitimate purposes.

3-calling the “issue of polytheism” with the Hamaria, the Hajari, or the Yamiyya, on the basis that the father does not exist, is not permissible.

because that is a contempt for what god commanded to be respectful and kind to him.

4-calling the brother without whom his sister would inherit “the sinister brother” is not permissible ; because law forbid pessimism.

5-it was narrated that the brothers from the father and mother said to Omar when he contributed to the brothers from the mother without them : “suppose that our father was a donkey, or suppose that our father was a stone thrown into the sea.

are we not from the same mother ?” i did not find it a Musnad, which is not acceptable Riwaya and Deraya.

6-the most correct opinion in this “issue” is the fall of sibling brothers, and their failure to participate in the brothers of a mother in the imposition of a third, which is what a group of investigators favored.
