The institution of a proceeding for the (National Social Security Fund) forced collection of contributions to the fund raises some legal issues, which make recourse of the said institution to the mechanisms provided for in the 'Code for Collection of Public Debts' legally unfounded on account of the fact that the General Directorate of National Social Security Fund has no standing to collect its debts owed by the employers within the framework of this Code.

Alternatively, the said CNSS Fund and its affiliated members have another procedural claim mechanism, which consists in invoking the penal provisions that are applicable to the collection of contribution dues as part of an action for collection of contribution dues and which is subsidiary to the public prosecution.
