Referring to the Moroccan legal system, we note the absence of special legal rules regulating and codifying the field of consumer loans, in a way that provides special protection for the borrowing consumer, unlike what is required in comparative legislation, with the exception of some periodicals and regulatory texts issued by the competent administrative regulatory authorities.

Hence, the reality of economic life and the role that banks occupy with their income necessitates dealing with interest, as the Moroccan legislator has set the legal framework to encourage initiative in the field of foreign investment and by amending the banking system: this implicitly confirms his approach to perpetuating the permissibility of dealing with interest.
