أصدر المشرع الجزائري عدة قوانين حاول بموجبها ضبط نشاط الترقية العقارية، و تنظيم عمل القائمين به لينص أخيرا في القانون رقم 04/11 الذي يحدد القواعد التي تنظم نشاط الترقية العقارية على تنظيم قانوني خاص بمهنة المرقي العقاري فأخضع هذه المهنة إلى أخلاقيات يسهر على احترامها المجلس الأعلى للمرقين العقاريين.
و لقد خص المشرع الجزائري موضوع المسؤولية العشرية للمرقي العقاري بنصوص بعضها صريح و الآخر يحتمل التأويل، رغبة منه في حماية المكتتب مشتري البناية و المتضررين من تهدم البناء و تعيبه.
Abstract EN
The Algerian legislator worked hard to pay attention to the field of real estate promotion, so he issued several laws according to which he tried to control the real estate promotion activity on the one hand, and organize the work of those in charge of it on the other hand, to adopt under Law no .11/04, specifying the rules regulating promotion activity real estate, he subjected this profession to ethics that the Supreme Council of Real Estate Promoters ensures respect.
The Algerian legislator has singled out the issue of the decimal responsibility of the real estate promoter with texts, some of which are explicit and the other ambiguous, in his desire to protect the subscriber, the buyers of the building in particular, and those affected by the demolition and defectiveness of the building in general.

Le législateur algérien a travaillé dur pour prêter attention au domaine de la promotion immobilière, il a donc promulgué plusieurs lois selon lesquelles il a essayé de contrôler l'activité de promotion immobilière d'une part, et d'organiser le travail de ceux qui en ont la charge sur le D'autre part, à adopter en vertu de la loi n° 11/04 précisant les règles réglementant l'activité de promotion immobilière, il a soumis cette profession à une déontologie que le Conseil Supérieur des Promoteurs Immobiliers veille au respect.
Le législateur algérien a épinglé la question de la responsabilité décimale du promoteur immobilier avec des textes dont certains sont explicites et d'autres ambigus, dans sa volonté de protéger le souscripteur, les acquéreurs de l'immeuble en particulier, et les personnes concernées par la démolition et la défectuosité du bâtiment en général.
