الأصل هو أن تقام دعاوى أجر المثل بالاستناد إلى النصوص التشريعية المقررة في القانون المدني، حيث نجد أساسا قانونيا لإقامتها، فنجد القواعد القانونية التي تضمنتها النصوص التشريعية المنظمة للغصب أو لمنع المعارضة أو المنظمة لعقد الإيجار على سبيل المثال، تمثل أساسا قانونيا صريحا لإقامة هذه الدعاوى.
و في ذات الوقت ؛ توجد أسس و قواعد قانونية عامة لدعاوى أجر المثل، تضاف إلى ما تبناه المشرع العراقي المدني من نصوص تشريعية تضمنت صورا لفروض و احتمالات متنوعة لحالات المطالبة بأجر المثل، تمت صياغتها بشكل قواعد قانونية صريحة، و وضعت لها أحكام قانونية، بحسب الوضع الخاص بكل واقعة، و قد تولى القضاء تطبيقها على ارض الواقع، حيث برز فيها التنوع و التعدد في الصور التي يمكن أن تظهر بها هذه الدعوى في الواقع العملي.
الأمر الذي دفعنا لدراسة هذه التطبيقات من خلال الوقوف على توصيفها القانوني و الصور التشريعية و القضائية الخاصة بها.
Abstract EN
The origin is that the proverb wage lawsuit are based on the legislative texts established in the civil law, where we find a legal basis for their establishment, so we find the legal rules included in the legislative texts regulating rape or to prevent opposition or the organization of the lease contract, for example, that represent an explicit legal basis for the establishment of these cases.
at the same time ; there are general legal bases and rules for proverbial wage claims, in addition to the legislative texts adopted by the Iraqi civil legislator that included images of various assumptions and possibilities for cases of claiming proverbial wages.
they were formulated in the form of explicit legal rules, and legal provisions were set for them, according to the specific situation of each incident, and the judiciary took over its application on the ground, where the diversity and plurality of images in which this claim can appear in practice.
which prompted us to study these applications by standing on their legal description and legislative and judicial images of them.

Le principe est que les actions de loyer de propriété similaire sont légalement intentées sur la base des règles du droit civil ; on les retrouve notamment dans les textes ayant trait au bail, au dol ou viol ou dans le cas de trouble dans la possession ou de réintégrande.
il existe, au même temps, d’autres bases légales générales de l’action en loyer similaire prévues dans la législation irakienne sous forme de règles juridiques explicites en fonction de chaque incident sur la propriété.
de telles bases sont mises en oeuvre par la jurisprudence irakienne et, l’on retrouve plusieurs formes d’actions en loyer similaire.
c’est ce qui nous a amené à engager la présente étude en tentant de qualifier les différentes formes de l’action en loyer similaire.
