Abstract EN

Various legislations impose the need to obtain the consent of the convict in order to apply alternatives sentences to him .because the idea of adopting the consent of the convict is a mechanism of rationalization of the sentence insofar as the involvement of the convict in his implementation contributes to reform and better reintegrating him into society and to achieve so-called consensual justice which includes all stages of criminal procedure up to the stage of punitive execution by introducing alternatives penalties to the custodial sentence to be implemented with the cooperation of the convict.

this is established by the Algerian legislator through its adoption of the electronic surveillance provided for by law 18-01 supplementing law .05-04 on the law on the organization of prisons and the social reintegration of detains .this system based on the need for the convicted person’s consent in order to apply it.
