The family is the basic cell of society, which by its stability this later grows and flourishes.

hence, all the monotheistic religions and most of the man-made laws were keen to protect it, and this was enshrined by the Algerian legislator when he established a special law for the family, regulating the method of its establishment and the rights and duties of each individual in it.

with the development of living conditions, the spread of globalization, and the crises experienced by the Algerian society, the family has become subject to many violence and problems that threaten its entity and stability, and the rules of family law are no longer sufficient to protect it, thus the penal code had to intervene to confront the violence that affected members of the same family.

this is what prompted us to choose this topic in which we are trying to answer the following problem: to what extent can the Algerian penal code protect the family?.
