As much as the benefit that humanity reaps from the endless technological development, as much as it forms a horror on aspects of human life, the most important of which is the aspect of digital privacy, the enactment of preventive legislation is one of the most important ways that various countries have guided to protect personal privacy from attacks by individuals and collectively, but these legislations, on the other hand, have opened a wide scope for states and governments to violate the digital privacy of individuals under the pretext of preventing crimes affecting national security or cross – border crimes.

This was the case with the Algerian legislator, who singled out the laws enacted in the field of public authorities with exceptions that allow them to penetrate privacy whenever they deem it necessary, according to the law, this is what prompted us to research the limits of these exceptions, and this is through an analytical study of law No.
