The legislator always tries to find suitable solution, as dictated by the objectives of modern penal policy pursued, by the comparative systems developed in the penal field each time a new crime appears, by establishing laws adapted to the seriousness, and to the scale of the crime, and keeping pace with current developments in the field of the means used to commit the offence, with the aim of combating crime in general, and organized crime in particular, thus protecting the legally protected interest.

on this basis, the legislator followed this approach, when he enacted a special law n°: 21-15 to combat illicit speculation, which was provided for and punished by the penal code, so this law dealt with the aspect preventive by providing everything the citizen needs to eliminate the shortage, as well as raising awareness of the risk of crime before he imposes sentences that were equivalent to life imprisonment.
