The method of privatizing penal institutions is one of the new systems to confront the disadvantages of freedom-depriving penalties, the most prominent of which is the prison overcrowding crisis, and the resulting burden on the public treasury with huge financial burdens, as well as the high rate of recidivism, due to the mixing of prisoners and their overcrowding with each other, which made the penal institutions schools to produce new criminals due to their failure to implement reform and rehabilitation programmes, and we have tried in this study to shed light on the historical development of this method, and the jurisprudential controversy that accompanied it from supporters and opponents of the idea of privatizing prisons, as well as highlighting the reality of the policy of privatizing penal institutions in Algeria.
