The function of the presidency of the republic in Algeria was greatly affected by the authority of the French regime, which confirmed the superiority of this authority under the constitution of 58; however; according to the first constitution in 63; the first presidency of the Algerian republic was formed, which has already given a special advantage and a distinct position at the forefront of constitutional institutions, especially the last constitutional amendment of 2020; by accumulating all functions in the hands of the president of the republic; who dominates many constitutional powers under normal circumstances, due to the lifting of constitutional restrictions on some powers and political responsibility and the failure to activate criminal responsibility; to expand more under exceptional circumstances in favor of the president of the republic.

from this point of view; the development of the position of the president of the republic does not negate the fact that the person familiar with the legal history of Algeria knows that the president of the republic is the person who possesses power alone, he is not responsible for the work he performs while exercising his functions with absolute immunity; without delegating others whether within the framework of the political system based on unilateralism or pluralism; and according to the above; the constitutional institution of the presidency of the republic, represented by the person of the president of the republic; has become the effective and dominant organ of political and constitutional life in Algeria.
