The Algerian legislator has tried, through a number of legal texts, to control and regulate the process of establishing, running and monitoring institutions and centers for the reception of young children, but the last text in force, which is executive decree n° 19-253.

it raised many problems in practice and clearly hindered the state's strategy to provide the largest possible number of these institutions.

which made the researcher seek to lay hands directly on the difficulties facing the creators of this type of structures in order to find legal solutions that facilitate and simplify the process of establishing small childhood reception institutions, without compromising the comfort, well-being and stability of children within these structures as the desired goal.
