An insurance contract is a contract of a special nature that has a set of characteristics, the most important of which is consensual and synallagmatic contract, which is binding on two sides.

it is a probabilistic and a netting contract, and it is one of the continuous contracts, and it is also considered as a contract of submission , executed in good faith.

and for this, it requires a special legal construction in its various elements , which gave it some peculiarities, whether at the level of consent, object or cause, and this is what we have tried to clarify in this paper.
