يعد مجلس الأمن الجهاز الأساسي والهيئة التنفيذية لمنظمة الأمم المتحدة الذي أسندت إليه مهمة حفظ السلم والأمن الدوليين عملا بأحكام ميثاق الأمم المتحدة، لذا فهو يقع عليه عدة التزامات من بينها التزام بتنفيذ قواعد القانون الدولي الإنساني.
كما يقع على الدول أيضا التزام تنفيذ قواعد القانون الدولي الإنساني تطبيقا للمادة الأولى المشتركة لاتفاقيات جنيف الأربع لعام 1949، ففي حالة انتهاكها لتلك القواعد يتدخل مجلس الأمن لوضع تلك القواعد حيز التنفيذ باتخاذ إجراءات ضد هذه الدول لحملها على احترام قواعد القانون الدولي الإنساني سواء بفرض عقوبات اقتصادية كإجراء غير قمعي، أو باستخدام القوة المسلحة كإجراء قمعي.
كما يتدخل مجلس الأمن بفرض عقوبات فردية على الأشخاص المسؤولين عن ارتكاب انتهاكات لقواعد ومبادئ القانون الدولي الإنساني، وهذا للحد من ظاهرة الإفلات من العقاب وإعمالا للمسؤولية الجنائية الفردية وذلك من خلال وضع آلية قانونية تتمثل في إنشاء أجهزة قضائية دولية لإثبات الفعل الإجرامي ومتابعة مسؤولي الدولة المعنيين بهذا الفعل وكذا لإرساء قواعد قانون جنائي دولي.
سنحاول من خلال هذه الدراسة التطرق للإجراءات التي يتخذها مجلس الأمن في ردع انتهاكات القانون الدولي الإنساني.
Abstract EN
The security council is the principal organ and executive body of the united nations organization that has been entrusted with the task of maintaining international peace and security in accordance with the provisions of the charter of the united nations.
therefore, it has several obligations, including the obligation to implement the rules of international humanitarian law, and this is the same obligation that falls on states.
if these provisions are violated, the security council will intervene to put those rules into effect by taking action against these countries, whether by imposing economic sanctions as a non-repressive measure, or by using armed force as a repressive measure.
the security council also intervenes by imposing individual penalties on responsible persons in application of individual criminal responsibility, and by establishing international judicial bodies to prove the criminal act and to pursue state officials concerned with these crimes.
