إن حماية التوازن البيئي جاءت محاطة بجميع الجوانب حيث قام المشرع البيئي بوضع حماية لكل عنصر من عناصر النظام الأيكولوجي ماء، هواء، الأرض بتخصيصه فصل مستقل من الباب الثالث من القانون رقم 03-10 المتضمن حماية البيئة في إطار التنمية المستدامة لمقتضيات حماية التنوع البيولوجي والفصل الثاني خصصه لمقتضيات حماية الهواء والجو والفصل الثالث لمقتضيات المياه والأوساط المائية وانحرافه عن أركان الجريمة والتركيز عن الجرائم الشكلية وخصص عقوبات لكل عناصر البيئة في الباب السادس المعنون بالأحكام الجزائية.
