The enjoyment of human being with a fair trial is one of the basic rights guaranteed by constitutions and regulated by legislation, both in terms of their equality before the judiciary, or in terms of enabling individuals to defend themselves fully, or their right to pursue disputes, appeal, and object to judicial rulings before the higher judicial authorities.

the aim of this study is to reveal the extent to which the principle of the right to defense for a fair trial is achieved in an administrative case, how the administrative judge contributes to its implementation, this is through the powers granted to him in the conduct of the administrative case, which is due to the specificity and nature of the administrative dispute, which would preserve the rights and freedoms of individuals from the arbitrary administration, it has an impact on the litigants enjoying a fair trial.
