This paper focuses on understanding the nuances between the recognized therapeutic drugs characteristics under Algerian, European, & U.S health legislations; and the health claims (HCs) of dietary supplements (DS).

these claims are originally designed as marketing tools to highlight the health benefits of these products and to influence food choice for a growing segment of health-conscious consumers.

while these (HCs) are clearly defined in comparative law, we note a legal ambiguity about them in Algeria, which requires the legislator to regulating their future use; based on scientific evidence and verification; this is done by enacting a autonomed legal text to ensure that such claims actually protect consumers and their right to un-misleading or fake health information, and that these (DS) will provide useful and reliable information and will be understood by the average consumer.

this text will also serve as a guide for manufacturers and the media on how to use claims on (DS), with the aim of enhancing innovation potential and protecting competition, thus ensuring the effective functioning of this growing market.
