The fact that the government of a country may lack to the required experience in management of public utilities and delivering the public services to people in the best and fastest way such matter requires the necessity of existing the private sector through the form of an administrative contract.

this is the current situation in Saudi Arabia where private sector investment can help boost the economy of a country in such circumstances.

Various factors affect decisions of the private sector to enter into administrative contracts with governments including project size as well as the legal protection offered to private investments.

the protection sought by private investors may be granted through the method known as arbitration.

in view of the significant role which arbitration plays in such situations, this paper highlights the way it helps to resolve the issues faced by private parties and government when they enter into administrative contracts in the context of Saudi Arabia.
