الخلاصة تسعى هذه الورقة البحثية إلى اظهار خطورة الجرائم الدولية التي ترتكب ضد الإنسانية وكذلك الجهود المبذولة لضمان أعمال حقوق الانسان في حماية الشعوب ووقف الممارسات غير الإنسانية ضد المدنيين العزل أثناء الحرب او السلم.

وقدف هذه الدراسة إلى استعراض أهم الجهود الدولية المبذولة والرامية إلى التعريف بجريمة الإبادة الجماعية وتجريمها والمعاقبة عليها، إذ لا تزال هذه الجريمة غير مجزمة وغير معاقب عليها بشكل صريح في القوانين الوطنية للدول، وكذلك معرفة المواقف الدولية تجاه هذه الجريمة الدولية واليات المعاقبة عليها عند وقوعها ومعرفة شرط النية والعمل به في فهم الإبادة الجماعية ومدى تطبيق ذلك في العمليات العسكرية التركية في شمال شرق سوريا.

فالتعريف بخطورة هذه الجريمة وبيان أركاها كافة ليس كفيلا بمنع وقوعها، والسؤال الذي سنحاول الإجابة عليه هو: هل يتوفر شرط النية وشرط العمل من العمليات العسكرية التركية في شمال شرق سوريا؟ والفرضية التي يبنى عليها هذا البحث، هي إثبات توفر شرط النية والعمل لارتكاب جرائم دولية تتراوح بين جرائم ضد الانسانية وجرائم الحرب والابادة الجماعية ضد الكورد في شمال شرق سوريا وممارستها بشكل واسع النطاق لانتهاكات خطيرة عبر تلك العمليات مع وجوب معاقبتها وفقا للقوانين الدولية المعمولة.

English Abstract

This research examines serious international crimes practiced against humanity and it also displays international efforts invested in assuring the realization of human rights, justice for people and the prevention of inhuman practices against civilians during wartimes.

The study aims at reviewing the most important international efforts that aims at defining the crime of genocide and illustrating the prosecution and punishment of criminals.

Until this day, the crime of genocide remains unpunished by national laws of the countries involved.

In addition, this study pursues the effective methods needed to deal with this type of crime and how to develop these methods internationally.

Furthermore, the study will move on to analyze the effective methods of punishment and prevention by future governments.

Defining the crime of genocide and revealing its impacts are not enough to prevent this incident to take place in the future.

Therefore, this research attempts to answer the following question: what are the international measures taken into account to prevent this crime from happening as well as to punish whoever responsible for it? The thesis of this research highlights the demonstration of the crime of genocide and how it is pursued—in a large scale—by some governments.

Thus, it is significant to emphasize the necessity to punish whoever commits this crime by international laws.
