إذا بادرت الدولة بالانخراط في عملية مواءمة القانون المحلي مع الاتفاقيات الدولية والإقليمية لمكافحة الفساد التي تم التصديق عليها من طرف الجزائر، يبين التحليل الدقيق للنصوص السارية وبوضوح عدم وجود إرادة صادقة للتصدي لهذه الآفة الحقيقية التي تعصف بالمؤسسات، وبالخصوص على أعلى مستويات السلطة.
وعليه وبالرغم من إنشاء آليات على المستوى المؤسسي وعلى صعيد الإجراءات المبادر بها، لا تزال الجزائر تسجل انخفاضا واضحا ومستمرا في ترتيب البلدان وفقا لمؤشر إدراك الفساد.
وبالتالي، فإن إنشاء مؤسسة جديدة لا يمكن أن يكون وحده بمثابة الحل الأمثل ما دامت الهيئة في وضعية تبعية قوية إزاء السلطة السياسية وكذا لكونها لا تستطيع أن تؤدي المهام الملقاة على عاتقها بكفاءة وفعالية بالنظر إلى التعدد المفرط للصلاحيات التي تم تزويدها بموجب القانون..
Abstract EN
If the State is engaged in a process of bringing domestic law into line with the international and regional conventions on the fight against corruption ratified by Algeria, a meticulous analysis of the texts in force clearly shows the absence of a real political will against this real scourge that plagues the institutions, especially at the level of the high spheres of power.
Despite the institution of mechanisms both at the institutional level and in terms of the procedures initiated, Algeria continues to record a clear decline in the ranking of countries according to the corruption perceptions index.
Thus, the establishment of a new institution alone cannot serve as a solution in so far as the body remains in a position of strong dependence on political power as it cannot function efficiently in view of the multiplicity of it shall have such powers as may be prescribed by law.

Si l’Etat s’est engagé dans un processus de mise en adéquation du droit interne avec les conventions internationales et régionales relatives à la lutte contre la corruption ratifiées par l’Algérie, l’analyse méticuleuse des textes en vigueur montre de façon éclatante l’absence d’une réelle volonté politique contre ce véritable fléau qui gangrène les institutions, particulièrement au niveau des hautes sphères du pouvoir.
En dépit de l’institution de mécanismes, tant au niveau institutionnel qu’au plan des procédures engagées, l’Algérie ne cesse d’enregistrer un net recul dans le classement des pays selon l’indice de perception de la corruption.
C’est ainsi que la mise place d’une nouvelle institution ne peut à elle seule servir de solution dans la mesure où l’organe reste dans une position de forte dépendance à l’égard du pouvoir politique, comme il ne peut fonctionner de manière efficiente au vu de la multiplicité des attributions que lui fixe la législation
