يترتب الوجود الواقعي للعقد في الميدان العملي، ليس فقط الآثار القانونية والاتفاقية التي تمس عاقديه من الأطراف الذين اشتركوا بإرادتهم في عقده أو هم وخلفهم العام والخاص، وإنما يمكن أن ينشأ من هذا العقد آثار تمس الأغيار البعيدين عن دائرة العقد ونطاقه، والذين يطلق عليهم فئة الغير، فهؤلاء يتأثرون بوجود العقد من ناحيتين، الأولى، كون العقد بالنسبة إليهم يعد واقعة قانونية لها حجية تجاه الكافة عليهم احترامها واحترام ما ينشأ عنها من آثار.
والثانية هي إن العقد ذاته بالمراكز القانونية التي ينشؤها يؤثر بمحيطه ويتأثر به سلبا وإيجابا، ومن ثم يكون من الضروري الوقوف على ماهية هذه الآثار والكيفية التي يتأثر بها الغير بوجود العقد وكيفية تأثر الغير بالعقد، ليس بوصفه تصرفا قانونيا إراديا يحكم العلاقة بين أطرافه، وإنما بوصفه واقعة قانونية لها وجود واقعي، تؤثر وتتأثر بما يجري في محيطها بشكل مباشر أو غير مباشر.
Abstract EN
The factual existence of the contract in the practical field entails not only the legal and treaty effects that affect its contracting parties from the parties who willingly participated in its contract or they and their public and private successors.
They are affected by the existence of the contract in two respects: The first is that the contract is for them a legal fact that has authority towards everyone, and they must respect it and respect the effects that arise from it.
The second is that the contract itself with the legal centers that it creates affects its surroundings and is affected by it negatively and positively, and then it is necessary to determine what these effects are and how others are affected by the existence of the contract and how others are affected by the contract, not as a voluntary legal act that governs the relationship between its parties, but rather as a legal fact that has a real existence, that affects and is affected by what is happening in its surroundings, directly or indirectly.

L’existence factuelle du contrat en pratique produit ses effets juridiques et conventionnels, non seulement vis-à-vis des parties contractantes qui ont volontairement participé à sa conclusion, ou leurs successeurs, mais aussi envers les tiers, Ces derniers peuvent être affectés par l'existence de ce contrat à deux égards: le premier est que le contrat est, selon eux, un fait juridique qui fait autorité à l'égard de tous et qui doit être respecté ainsi que ses effets qui en découlent.
Le second est que le contrat lui-même, avec les centres juridiques qu'il établit, influence son environnement.
À cet effet, il nous semble nécessaire de déterminer les effets directs et indirects du contrat, en tant qu’élément factuel, sur son environnement.
