Abstract EN

The Algerian legislator tried to establish the electronic sales and he worked on approving various guarantees for the buyer to protect him as the weak party to the contract, among these guarantees is what is decided at the stage before the conclusion of the electronic sales contract, and there are those imposed at the stage of concluding and implementing the contract, but the law No 18-05 relating to electronic commerce did not regulate these guarantees, as the buyer always finds himself obligated to refer to the general rules of the civil code.

Le législateur algérien a consacré le contrat de vente électronique.

Il s’est efforcé d’offrir des garanties pour protéger l’acheteur en tant que partie faible du contrat.

Ces garanties interviennent, à la fois, avant la conclusion du contrat de vente électronique, au stade de sa conclusion et lors de son exécution.

Toutefois, la loi no 18-05 relative au commerce électronique n’a pas organisé ces garanties,elle renvoie l’acheteur aux règles générales du droit civil.
