Abstract EN

Marriage between a man and a woman is one of the most important nonfinancial systems and contracts for a human being, and it is the right way on which a healthy and strong society is built, according to which families are formed on the basis of a good relationship between the spouses in order to achieve the principle of tranquility, affection and mercy, and to ensure the achievement of family bonding and solidarity.

Marriage, as a contract in which cohabitation is permissible between a man and a woman, may raise the issue of the religion of one of the spouses, as a Muslim may marry a non-Muslim woman of the book with a legal contract based on all the pillars and conditions that came with Islamic law, as well as an arrangement for its effects.

The marriage of a Muslim to a non-Muslim woman of the book remains specific in some issues, unlike the marriage of a Muslim man to a Muslim woman, especially with regard to the conditions and effects of the marriage contract

Le mariage entre l’homme et la femme est l’un des plus importants contrats non financiers pour l’humain.

C’est la bonne façon de bâtir une société forte et saine.

Il permet la construction d’une famille sur la base d’une bonne relation entre le couple pour atteindre les principes de quiétude, d’affection, de miséricorde et garantir la réalisation de la corrélation et de la solidarité familiales.

Le mariage est un contrat qui ouvre la voie à la bonne compagnie au sein du couple.

Dans ce contexte, la question de la religion d’une partie du couple peut se poser, dans le cas d’un mariage d’un musulman avec une femme non musulmane des gens du Livre par un contrat légal avec les implications qui doivent obéir aux principes et conditions de la charia islamique.

Le mariage de l’homme musulman avec la femme non musulmane aura toujours une spécificité dans certaines questions contrairement à son mariage avec une femme musulmane principalement en ce qui concerne les conditions et les effets du contrat de mariage.
