في حالة توجي دعوى مجردة للدخول في مفاوضات و اجتمع أطراف التفاوض على إثرها دون أن يكون هناك أي إطار عقدي ينظم هذه العلاقة، فإن المخل بالتزامه بالتفاوض بحسن نية و ما يترتب عليه من التزامات مكملة له، يكون مسؤولا على أساس أحكام المسؤولية التقصيرية متى توافرت شروطها من خطأ، ضرر و علاقة السببية، و يلزم بالتعويض.
Abstract EN
If an action is initiated to enter into negotiations and the negotiating parties meet thereafter without any contractual framework governing this relationship, the breach of the party's obligation to negotiate in good faith and its complementary obligations shall be liable on the basis of the provisions of the default liability where its conditions are met by error, damage and causation, and compensation is required.
