Corruption and contract validity : the role of civil law and international instruments

This article explores the impact of corruption on contracts and the role of civil law in addressing this issue.

by analyzing existing literature, country review reports, and case studies, including anti-corruption laws from Algeria and other countries, we examine the intersection between corruption in a criminal context and its implications on contract validity.

measures such as concession withdrawal and debarment as administrative sanctions for corruption are discussed.

by examining review reports from different countries (united nations office on drugs and crime) about the implementation of article 34 of the united nations convention against corruption (UNCAC), we observe that most countries still need specific provisions dealing with the consequences of corruption on contracts.

without a specific provision regulating the consequences of civil law corruption, the study aims to highlight the importance of civil law in addressing corruption in contracts.
