C'est dans le cadre des séparations conflictuelles des couples binationaux que nous constatons l'intensification des enlèvements internationaux d'enfants connu sous l'appellation de « rapt parental », son caractère international et la multiplicité des textes applicables rendent cette infraction très complexe qu'on essayera d'éclaircir à travers cet article, Face à l'absence de cette infraction dans le droit interne c'est le droit international privé qui a fait face à ce phénomène par le biais des conventions internationaux et européens mais qui engendre un bon nombre de difficultés d'application, Reste la solution à l'amiable qui est très recommandée pour amortir les méfaits d'une bataille judicaire sans merci dont la victime principale est « l'enfant ».

abstractIt is in the context of the conflicting separations of binational couples that we note the the rise of international kidnappings of children known as the “Parental Abduction”.

Its international character and the multiplicity of applicable texts make this offense a very complex one.

That's what we will try to clarify through this article, In view of the absence of such an offense in domestic law, it is the private international law that has dealt with his phenomen on by means of international and European conventions, but still this gives rise to a good number of difficulties of application.

There still remains the amicable solution which is highly recommended to soothe the misdeeds of a merciless legal battle in which the main victim is "the child".
