Abstract EN

The constitutions differed in determining the position of the President of the Republic, especially his role in his relationship with the Parliament.

Most of the constitutions assigned the President of the Republic wide powers towards Parliament, as they granted him several powers.

The most serious of which was what was termed as “dissolving Parliament” before the end of its legal term, whereby the executive authority could resort to it in case of intransigence.

The legislative authority, however, the right of dissolution may be used in an arbitrary manner.

Therefore, most constitutions have established certain controls that the President of the Republic must respect before resorting to it, because of the effects that it has on it.

Perhaps the most important of which is the transfer of legislative authority from Parliament to the executive authority.

It is noticeable that the right to solution is a mechanism that is not limited to a specific constitution, but extends to many constitutions of the world, including the Algerian constitutional amendment in 2020, which is what this study dealt with compared to some of its applications in some constitutions of the world.
