Abstract EN

The main objective of this study is to shed light on the rights of children resulting from invalid marriage in the Algerian family law in relation to their father, and consequently aims to search for the reasons for the invalidity of the marriage contract in the Algerian family law, where it was concluded that the reasons for invalidity of marriage in the family law are limited to four Reasons set out in Articles 32, 33 and 34 of the Family Code.

It was also concluded that the position of the legislator Algerian was frank about the issue of children attributed to their father in general, where most of the jurisprudence rules established by the adoption of Shariah scholars when they talk about the child ratios, including the revival of the child base, which is evident from its applications that marriage is wrong fit because be a reason for evidence of the boy attributed to his father, with the need to respect a number of conditions for the control of this right.
