Arabic Abstract

يعالج هذا البحث موضوع التفريق القضائي بين الزوجين للفقدان الزوج بدراسة مقارنة بين الفقه الإسلامي و قانون الأسرة الجزائري، حيث يعد هذا الموضوع مشكلة من المشاكل التي تؤدي إلى التفكك الأسري، و يكون سببها الزوج إذا ألحق ضررا بزوجته سواء أكان ماديا أو معنويا، و يكون ذلك بناء على طلب الزوجة و بإرادتها المنفردة، و لا يتم إلا بحكم قضائي مسبوقا باجتهاد و لو عارضه الزوج طالما أنها متضررة، و يفرق القاضي بينهما بالنص القانوني الوارد في التقنين المعمول به.

وقد جاءت الشريعة الإسلامية لتقرر منهاجا فعالا في رفع الضر عن الزوجة وذلك بشتى الطرق الشرعية الممكنة، بذكر الأسباب التي تستند عليها الزوجة في طلب الطلاق، وقد وافقت القوانين الوضعية على ذلك

English Abstract

This research deals with the judicial distinction between spouses for the loss of spouses by examining a comparison between Islamic jurisprudence and Algerian family law family disintegration ", where this is a problem leading to family disintegration, It is caused by the husband if he causes damage to his wife, whether physical or moral.

This shall be at the request of the wife and her individual will, and shall be done only by judicial decision preceded by diligence, even if opposed by the husband as long as she is affected and the judge differentiates between them by the legal provision in the applicable codification.

The Islamic Shari 'a has established an effective approach to remove harm from the wife in all possible legitimate ways by stating the reasons on which the wife is seeking divorce, which the positive laws have approved.
