يتمحور هذا المقال حول دراسة الوصية في القانون الجزائري، حيث حاولنا من خلاله تسليط الضوء على كيفية إثباتها وكذا الإجراءات المتبعة لتثبيت الملكية المكتسبة عن طريقها، وذلك بهدف التعرف على مختلف الإجراءات والآليات القانونية التي وضعها المشرع الجزائري لتنظيم مختلف المسائل المتعلقة بالوصية، سواء تعلق الأمر بإثباتها أو بالإجراءات المتبعة لتثبيت الملكية المكتسبة عن طريقها.
هذا وسنحاول من خلال مقالنا هذا الإجابة على إشكالية تتمحور حول طرق إثبات الوصية في التشريع الجزائري والإجراءات الواجب إتباعها لتثبيت الملكية المكتسبة عن طريقها، وفي سبيل الإجابة على هذه الإشكالية اعتمدنا في مقالنا هذا على كل من المنهجين الوصفي والتحليلي باعتبارهما الأنسب لمثل هذه الدراسات، إضافة إلى المنهج المقارن؛ والذي اعتمدناه في بعض الثنايا، وقد خرجنا من خلال دراستنا لهذا الموضوع بمجموعة من النتائج التي أوردناها في نهاية المقال.
Abstract EN
This intervention deals with the study of proof of the will in Algerian law as well as the procedures to establish ownership acquired through it, where we aim to shed light on the various procedures and mechanisms developed by the Algerian legislator to regulate matters related to the will, whether it is to prove them or the procedures used to establish ownership acquired through them.
where we try through this intervention to answer the problem centered on the ways to prove the will in the Algerian legislation and the procedures to be followed in the confirmation of ownership acquired through it, and we have adopted in this intervention and to answer the problem raised both descriptive and analytical approaches to their suitability for this type of study as well as comparative in some folds.
