Abstract EN

Under the constitutional Amendment of 2020, the constitutional control system in Algeria marked a turning point in its evolution process, the constitutional founder decided to replace the constitutional Council which its political nature, by a constitutional Court, characterized by the academic nature of its components, while explicitly reinforcing the court's role in the regulation of constitutional institutions functioning.

This article highlights the widening gap between the scope of the mission assigned to the constitutional court, and the legal means at its disposal to achieve its goal of ensuring the respect of the constitution, especially in the light of the broad powers attributed to the president of the republic with regard to the establishment of the law rule in one hand, and the sweeping constitutional powers bestowed upon him, making the president of the republic the focal point in Algeria's political system on the other hand.
