Abstract AR
هدفت الدراسة للوقوف على العرف الشرعي حجيته، و أسبابه، و مجالاته تطبيقا على بعض الأعراف و العادات السودانية و بيان التعريفات اللغوية و الاصطلاحية للعرف و الفرق بينه و بين العادة و إيراد الأدلة الشرعية على حجيته كما بينت الدراسة أقسام و شروط العرف و مجالاته، وقفت الدراسة على بعض الأعراف و العادات السودانية من حيث الموافقة و المخالفة للشريعة الإسلامية، توصلت الدراسة إلى بعض الأعراف السودانية الصحيحة مثل القلدوالضيافة في رمضان وغيره، وكيفية إطعام أهل الميت، كذلك وقفت الدراسة على بعض الأعراف و العادات السودانية المخالفة للشريعة الإسلامية كالجليد السوط في الأعراس - البطان، و بعض طقوس الأعراس في السودان و الكجور والزار و تأصلها من الناحية الشرعية.
ترجع أهمية الدراسة إلى إلقاء الضوء على الأعراف و العادات السودانية و تصنيفها سلبا أو إيجابا و بيان الحكم الشرعي لها، تلخصت منهجية الدراسة في اتباع المنهج الاستقرائي التحليلي، الاختصار على بعض الأعراف السودانية، رجعت إلى أمهات الكتب و المصادر و شبكات الانترنت الحصر الموضوع، و نسبت الآيات إلى سورها مع ذكر رقم الآية خرجت الأحاديث من مظانها.
Abstract EN
The study aimed to identify the legitimate legal authority, its reasons, and its fields in application of some Sudanese customs and customs, and to clarify the linguistic and idiomatic definitions of the custom and the difference between it and the custom, and to provide legal evidence for its authority.
the study also showed the sections.
and conditions of the custom and its fields.
for islamic law, the study found some correct sudanese customs such as imitation, hospitality in ramadan and others, and how to feed the dead's family, legally.
the importance of the study is due to shedding light on the sudanese customs and customs and classifying them negatively or positively and clarifying the legal ruling on them.
the methodology of the study was summarized in following the analytical inductive approach.
the number of the verse, the hadiths came out of their sources.
