Abstract EN

In this research, I will address the issue of men’s guardianship over women from a jurisprudential perspective, and a modernist perspective, showing the traditional legal rooting for women’s guardianship, the modern vision of women’s natural rights that do not conflict with the spirit of the holy Qur'an, and the purposes of Islamic sharia which emphasized the total ethical rules over the parts that contradict with the natural rights of women, which god created before the heavenly religions.

we will also talk about the duties of men towards women, and highlight the status of women on the subject of guardianship, and we will highlight the suspicions of guardianship and problems related to the rulings of women in Islamic sharia and the principle of justice and equality within the framework of women’s rights.

I will also address the status of women in the foundational texts, women and guardianship in Islam, the foundations of guardianship, divine preference and spending, violence against women as a component of stewardship, stewardship and the right to equality.
