Abstract EN

In our research, we discuss a topic that affects a large segment of those affected by the consequences of the emerging corona virus (Covid-19), namely the tenants, as the Cabinet of Ministers in the State of Kuwait issued many decisions to reduce the repercussions of the Corona virus, which resulted in that some tenants were unable to benefit from the use of the rented eye, as the total or partial closure of some professional, craft or commercial activities can affect the tenant's ability to fulfil his obligation to pay the fare.

But will tenants for residential purposes be affected by these decisions as well ? In order to demonstrate the impact of the virus consequences on rental contracts, we will go into depth to determine the legal adjustment of these consequences and their impact on the tenant's obligation to pay the rent.

So, will we be in front of force majeure, emergency circumstances, or special circumstances stipulated in the laws relating to lease ? And if it comes to one of them, will we be in front of circumstances determined by the judge when the tenant of his own accord did not pay the fee ? This is what we are trying to answer in this research.
