ينص الدستور المغربي لسنة 2011 في الفصل 70 منه على صلاحية جديدة للمؤسسة البرلمانية، المتمثلة في تقييم السياسات العمومية.
و قد بين الفصل 101 من نفس الدستور آليات تطبيق هاته الصلاحية ؛ حيث أرسى بموجب هذين الفصلين إطارا دستوريا جديدا لتقييم البرلمان للسياسات العمومية للمملكة المغربية، و ذلك أسوة بالتجربة البرلمانية الفرنسية التي كانت سباقة في دسترتها لهاته الوظيفة البرلمانية.
و من ثم، فإن هاته الدراسة تتناول دراسة مدى فعالية المؤسسة البرلمانية المغربية في ممارسة وظيفة تقييم السياسات العمومية مقارنة بنظيرتها الفرنسية، و تحديد الإطار الدستوري المنظم لها و كيفية ممارستها لهاته الوظيفة، و إبراز أوجه التشابه و الاختلاف بين التجارب مح الدراسة و المقارنة بينها.
هذه المقالة في أصلها جزء من أطروحتي لنيل الدكتوراه بعنوان : السلطة المالية للبرلمان : مكامن الضعف و مدخل الإصلاح : دراسة مقارنة بين التجربة المغربية و الفرنسية، تحت إشراف الأستاذ عبد الحق عزوزي بجامعة سيدي محمد بن عبد الله بفاس سنة 2021-2022، ثم حينت معطياتها بصيغة جديدة للنشر.
Abstract EN
The Morocco's 2011 constitution, article 70, provides for a new power for the parliamentary institution to evaluate public policies.
Article 101 of the same Constitution sets out the mechanisms for the application of This authority established under these two chapters a new constitutional framework for the parliament's evaluation of the public policies of the Kingdom of Morocco, similar to the French parliamentary experience, which was the first to constitutionalize this parliamentary function.
this study examines the effectiveness of the Moroccan parliamentary institution in exercising the function of evaluating public policies compared to its French counterpart, determining the constitutional framework governing it and how it exercises this function, and highlighting the similarities and differences between the experiences examined and comparing them.
