The use of the concept of terrorism and the concept of political crime is confused because of the political motivation, that the two crimes share historically.

The political content of political crime push the disagreement between the European countries by virtue of a set of considerations, the most important is the political one.

Whereas, agreement on the determinants and content of political crime obliges them to cooperate and coordinateinterms of deportation and extradition of criminals and exchanging informations.

Which means that the interests of many parties will be questioned, and pushed countries to separate the terrorist crime fromitspolitical content as they canconfrontit from a legal and procedural point of view.

It is true that the political motivation of both the political crime and the terrorist onehave an important role in adapting and the determination of the crime, but this cannot take away the functional and procedural importance of isolating the actsconstitutingterrorist crime from its political goal, even if the goal behind it is to change all or just a part of institutions of the state.

The methodological importance resulting from this isolation is extremely influential, as it enables judicial practitioners to be liberated from the specific political motivation of the terrorist crime, and the legislator to elaborate a rational criminal policy so as to confront this phenomenon.
