The Algerian legislator has granted the litigants in the civil lawsuit the right to resort to judicial reconciliation as an alternative measure to litigation to resolve the dispute in question, according to article 4 of the code of civil and administrative procedures, which states that “the judge can conduct reconciliation between the parties during the course of the dispute in any matter whatsoever.” this embodies this the article is one of the most important principles on which the Algerian judiciary is based, which guarantees litigants a fair trial in accordance with the constitution, principles of justice, international conventions, and the proper functioning of the judicial facility.
