Abstract EN

The wife-according to the majority of jurists-has the right to request a separation between her and her husband if he is absent from her for a certain period, and this is what the Algerian family code stipulated in article 53 considering absence as a reason for divorce.

the legislative treatment of this issue was characterized by a deficiency which took several aspects & in this research, we clarified them and presented appropriate proposals to confront them.
