Arabic Abstract
هدفت هذه الدراسة إلى التركيز على مدى فعالية النصوص الجزائية الموضوعية في تجريم نشر الشائعة عبر الموقع الإلكتروني، وقد استخدم الباحث منهج البحث الوصفي التحليلي بوصف وتحليل المسؤولية الجزائية للموقع الالكتروني عن نشر الشائعة في التشريع الأردني، وتوصل الباحث إلى عدة نتائج ابرزها ان المشرع الأردني لم يورد نصا خاصا بجريمة بث الشائعات وانما أوردها ضمن حالات معينة تمس مواضيع تعني بالوضع المالي أو قضايا أمن الدولة، وكان على المشرع الأردني الانتباه لهذه الظاهرة خاصة أنها أصبحت منتشرة على الموقع الالكتروني ولها أبعاد وآثار سلبية على الفرد وعلى المجتمع، كما ان المشرع الأردني لم يحدد الطريقة التي يمكن ان تتم بها بث الشائعة والأخبار الكاذبة، وأوصى الباحث بضرورة العمل على تطوير التشريعات لمواجهة ترويج الشائعة عبر الموقع الالكتروني لحماية الدولة والمجتمع بإجراء تعديلات تشريعية تفرض رقابة صارمة على الموقع الالكتروني الذي يروج الشائعة.
English Abstract
This study aimed to focus on the effectiveness of the substantive penal texts in criminalizing the dissemination of rumors via the website.
the researcher used the descriptive analytical research method to describe and analyze the penal responsibility of the website for spreading rumors in Jordanian legislation.
the researcher reached several results, the most prominent of which is that the Jordanian legislator did not include a text on the crime of spreading rumours, but included it in certain cases that touch on topics concerned with the financial situation or issues of state security.
the Jordanian legislator had to pay attention to this phenomenon, especially as it has become widespread on the website and has negative dimensions and effects on the individual and society, and the Jordanian legislator did not specify the way in which rumors and false news could be broadcast.
the researcher recommended the need to work on developing legislation to counter the promotion of rumors through the website to protect the state and society by making legislative amendments that impose strict control on the website that promotes rumours
