Arabic Abstract

إن جائحة كورونا، وما أدت إليه الإجراءات الاحترازية المتخذة في مواجهتها، أثرت وبشكل واضح ومباشر على مختلف القطاعات، والتي كان في مقدمتها قطاع النقل الجوي، فكان بديهيا امتداد هذه الآثار على الالتزامات التعاقدية لشركات الشحن الجوي العاملة ضمن هذا القطاع، وقبل بيان هذا الأثر تناولت الدراسة الطبيعة القانونية لمسؤولية شركات الشحن الجوي عن طريق بيان الآثار المترتبة على عقد النقل ونطاق مسؤولية هذه الشركات وفق القوانين الأردنية والعراقية والمصرية والاتفاقيات الدولية، ومن بعدها بيان ماهية جائحة كورونا وآثارها على قطاع النقل الجوي ومن ثم أثرها على مسؤولية شركات الشحن الجوي، ومدى اعتبارها سببا يعفي شركة الشحن الجوي من المسؤولية بتصنيفها إما كقوة قاهرة أو ظرف طارئ، فتوصلت الدراسة إلى ان اعتبار جائحة كورونا قوة قاهرة، تعفي شركة الشحن الجوي من المسؤولية هي مسألة موضوعية تعود إلى طبيعة الأثر المترتب ووقت إبرام العقد، أي أن هذه الجائحة إذا كان أثرها مستحيل الدفع فهي قوة قاهرة وإذا كان هذا الأثر يرهق تنفيذ الالتزام فهي ظرف طارئ.

وأوصت الدراسة بضرورة وضع تشريع خاص ينظم تأثيرات جائحة كورونا على الالتزامات التعاقدية باعتبار ان هذا الوباء ممتد إلى الآن ومن غير المعروف متى سينتهي ويتم السيطرة على آثاره.

English Abstract

The corona pandemic, and what the precautionary measures taken in confronting it led to, have clearly and directly affected various sectors, foremost of which was the air transport sector.

the study of the legal nature of the responsibility of air cargo companies by stating the implications of the transport contract and the scope of the responsibility of these companies in accordance with Jordanian, Iraqi and Egyptian laws and international conventions, and then a statement of the nature of the corona pandemic and its effects on the air transport sector, and then its impact on the responsibility of air freight companies, and the extent to which it is considered a reason it exempts the air cargo company from liability by classifying it as either a force majeure or an emergency circumstance, so the study concluded that considering the corona pandemic a force majeure, the air freight company is exempted from liability is an objective issue that goes back to the nature of the consequences and the time of the conclusion of the contract, that is, this pandemic if its impact is impossible payment is a force majeure, and if this effect burdens the implementation of the obligation, it is an emergency circumstance.

the study recommended the necessity of developing special legislation regulating the effects of the corona pandemic on contractual obligations, given that this epidemic is extended until now and it is not known when it will end and its effects will be controlled.
