Arabic Abstract

تهدف هذه الدراسة للوقوف على جوانب الحماية الجزائية للإرث الثقافي وبيان كيف وفر المشرع هذه الحماية، والبحث في القصور التشريعي للحماية الجزائية للإرث الثقافي وبالتحديد في القانون العراقي وبيان مدى موائمة التشريعات المعمول فيها في الأردن فيما يتعلق بالإرث الثقافي، وقد توصلت لمجموعة من النتائج أهمها: - اتضح لنا أن الإجراءات الواجب اتخاذها في التحري والتحقيق وباقي إجراءات المحاكمة لا تختلف عن باقي الإجراءات المتطلبة بصورة عامة فلا تتميز الإجراءات الجنائية في جرائم الإرث الثقافي عن غيرها من الجرائم - تبين لنا أن الجهات المختصة في كل من العراق والأردن لم تطبق بشكل دقيق ما تضمنته الاتفاقيات الدولية التي عالجت موضوع تجريم الاعتداء على الإرث الثقافي.

وقد أوصت الدراسة المشرع العراقي والأردني تحديد محكمة مختصة للنظر في الجرائم الواقعة على الارث الثقافي لتختص هذه المحكمة نوعيا في هذه الجرائم وذلك لأهمية وجسامة الضرر الحاصل من جراء هذه الجرائم.

English Abstract

This study came with the aim of examining the aspects of penal protection for cultural heritage and how did the legislator provide this protection and research into the legislative shortcomings of the penal protection of cultural heritage, specifically in Iraqi law indicating the extent to which the legislation in force in Jordan is compatible with cultural heritage.

the study reached a set of results, the most important of which are: •it became clear to us that the procedures to be taken in the investigation and the rest of the court procedures do not differ from the rest of the procedures required in general.

criminal procedures in cultural heritage crimes are not distinguished from other crimes.

•it became clear to us that the competent authorities in both Iraq and Jordan did not accurately implement the contents of the international agreements that dealt with the issue of criminalizing the attack on cultural heritage.the study recommended that the Iraqi and Jordanian legislators define a competent court to consider crimes against cultural heritage.

this court specializes in these crimes due to the importance and gravity of the damage caused by these crimes.
