Arabic Abstract

تناولت هذه الدراسة "التنظيم القانوني لحرية الاجتماعات العامة والحق في التظاهر في ظل الظروف الاستثنائية" لبيان النطاق القانوني لتنظيم ممارسة حرية الاجتماعات العامة والحق في التظاهر، حيث حاولت هذه الدراسة الإجابة على مجموعة من التساؤلات التي شكلت محاور أساسية ورئيسية للدراسة، من خلال توظيف فصول هذه الدراسة للإجابة على هذه التساؤلات، لاسيما أن حرية الاجتماعات العامة والحق في التظاهر تعتبر من أهم الحقوق للتعبير عن الرأي كما انه يمس بممارسة الافراد لأهم حقوقهم المكفولة بالدساتير.

وقد تناولت هذه الدراسة بيان التنظيم القانوني لحرية الاجتماعات العامة والحق في التظاهر ومن ثم بيان أثر الظروف الاستثنائية على ممارستهم، من خلال بيان مفهوم حرية الاجتماعات العامة والحق في التظاهر وبيان أحكامها القانونية في القوانين الداخلية والاتفاقيات الدولية، ومن ثم بيان نطاق سلطات الضبط الاداري في ظل الظروف العادية والاستثنائية ونطاق الرقابة القضائية على القرارات الادارية المتعلقة بممارسة الاجتماعات العامة والحق في التظاهر في ظل الظروف العادية والاستثنائية.

توصلت الدراسة إلى أن المشرع في كل من الأردن والعراق قد منح الحاكم الإداري سلطات واسعة للتدخل في تنظيم وتقييد الاجتماعات العامة والمسيرات بهدف المحافظة على النظام العام، مما يتطلب الحد من هذه السلطات امتثالا لحرية الرأي والحق في التعبير.

English Abstract

This study dealt with "the legal regulation of the freedom in public meetings and the right to demonstration under exceptional circumstances" To indicate the legal scope for regulating the Practiceof freedom in public meetings and the right to demonstration.this study tried to answer a set of questions Which formed the main and main axes of the study, by use the chapters of this study to answer these questions, especially that the freedom in public meetings and the right to demonstrationis considered one of the most important rights to express opinion as it affects the practices of individuals for the most important rights guaranteed by the constitutions.

This study dealt with the statement of the legal regulation of the freedom in public meetings and the right to demonstration and then shows the impact of exceptional circumstances on their practices, through the statement of the concept of freedom in public meetings and the right to demonstration and the statement of its legal provisions in domestic laws and international conventions , And then indicate the scope of administrative control powers under normal and exceptional circumstances and the scope of judicial control over administrative decisions related to the practice of public meetings and the right to demonstrate under normal and exceptional circumstances .

This study found that legislatures in both Jordan and Iraq have given the administrative governor broad powers to interfere in organizing and restrictions of public meetings and demonstrations in order to governoratethe public system, which requires limiting these powers in compliance of freedom in opinion and the right of expression.
