Despite the Algerian legislator’s emphasis on the legal guarantees established for the protection of private real estate under the provisions of the Algerian Civil Code, the gravity of the attacks on real estate, their increase, forced the Algerian legislator to criminalize these acts through the text of Article 386 of the Penal Code.

However, this article raised many legal problems as a result of the ambiguity of the text of the article and the differences in its interpretation.

In the absence of a clear real estate policy for the legislator, and given the importance of this topic, we decided to research the topic of protection for private real estate in light of the attacks on it, which constitute a crime in itself punishable by law, for this and to access this topic through this research paper We will discuss the criminal protection of private real property Highlighting the conceptual framework of the crime of infringement on private real property by giving a definition of the crime of infringement on private real property and its pillars in the first requirement.

The images of the crime of infringement of private real property were addressed in the second requirement.

This is done by studying the procedures for following up on this crime in the first requirement, leading to the final penalties for this crime (the second requirement).
