The Algerian legislator agreed with the opinions of Islamic jurists on attaching a little importance to the definition of death as it is a purely medical issue.

however, he introduced brain death as a basic criterion for ensuring its confirmation.

he also identified the various indicators that doctors should rely in this regard.

this is demonstrated by the provisions of the health code, which stipulates that the confirmation of death must be met within the rules of human organs removal, and therefore it refers to the various decrees and ministerial decisions that serve medical and legal professionals, and provide penalties for doctors who do not comply with the applicable legislation.
