Penal protection is one of the most important forms of legal protection prescribed for information's and documents administratives, according its mechanisms, some of them are related to the thematic part by criminalizing various behaviors that constitute an infringement of them and determining the corresponding penalties, and others are related to the procedural part that shows the special procedures that should be followed in case of infringement, procedures which are related to the judicial jurisdiction as well as to the special investigative methods that occupy a great place in the public lawsuit because of its direct contribution to uncovering various crimes, apprehending the perpetrators and preventing their impunity by establishing evidence in them.

21-09 concerning the protection of information's and documents administratives includes special penal provisions that prevent them and forbides any assault against them, all this so as to ensure its preservation and embody their value to the state and its institutions.
